lookatmycards.com ("the Platform," "we," "us") is a listing and introduction service only. We provide a space for sellers to post trading cards for sale and for buyers to view listings and submit offers. When a buyer makes an offer, we forward contact information via email so the buyer and seller can negotiate and finalize price, payment, condition, authentication, shipping, insurance, and delivery terms directly with one another.
The Platform is not a party to, broker of, or guarantor of any transaction. We do not buy, sell, take possession of, inspect, grade, authenticate, ship, or insure any card. All negotiations, agreements, and exchanges of money or goods occur solely between the buyer and seller, at their own risk.
All listings, descriptions, images, and communications are provided by users, not by the Platform. THE PLATFORM MAKES NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, REGARDING:
ALL LISTINGS AND USER CONDUCT ON THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
By using the Platform to send or receive an offer, both the buyer and seller acknowledge and agree that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM, ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:
IN ANY CASE WHERE LIABILITY CANNOT BE FULLY DISCLAIMED UNDER APPLICABLE LAW, THE PLATFORM'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES, IF ANY, PAID BY THE USER TO THE PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
Each user agrees to indemnify, defend, and hold harmless the Platform and its owners, officers, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the user's listing, offer, or transaction; (b) any dispute between a buyer and seller; (c) the user's breach of these Terms; or (d) the user's violation of any law or the rights of a third party.
The Platform does not process payments, hold funds in escrow, or arrange shipping on behalf of users. Any payment method (cash, PayPal, Venmo, Zelle, cashier's check, etc.) and any shipping arrangement is chosen and executed entirely by the buyer and seller. The Platform recommends — but does not require — using trackable, insured shipping and a payment method with buyer/seller protection, and bears no responsibility if users choose not to.
Sellers represent that they own the item listed, have the right to sell it, and will describe it accurately and honestly to the best of their ability. Buyers represent that any offer made is made in good faith. Violation of these representations is a matter between the users involved and does not create liability for the Platform.
If a user has a dispute with one or more other users, that user releases the Platform (and its owners, officers, employees, and affiliates) from any and all claims, demands, and damages of every kind, known and unknown, arising out of or in any way connected with such dispute.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or use of the Platform (excluding disputes between buyers and sellers, which are solely between them) shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and each party consents to personal jurisdiction there.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between the user and the Platform regarding its use.
BY CLICKING "I AGREE," SUBMITTING AN OFFER, OR OTHERWISE USING THE PLATFORM TO LIST, VIEW, OR NEGOTIATE THE SALE OF A CARD, THE USER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE DISCLAIMERS, LIMITATIONS OF LIABILITY, AND INDEMNIFICATION OBLIGATIONS ABOVE.
